2. Statutory Guarantees (Australian Consumer Law)
Under the ACL, all products come with automatic consumer guarantees that cannot be excluded. Customers are entitled to a repair, replacement, or refund if a product:
- Has a major fault or defect that makes it unfit for its intended purpose.
- Does not match the description, sample, or demonstration model.
- Is not of acceptable quality, including durability and performance.
A major failure means the product:
- Is unsafe to use.
- Has a defect that would have stopped someone from buying it had they known.
- Cannot be easily fixed within a reasonable timeframe.
If the failure is minor, we may offer a repair or replacement, rather than a refund. The determination of whether an issue is major or minor is based on ACL guidelines.
