Consumer Guarantees Policy

1. Introduction
The Groove Man is committed to upholding the rights of consumers under the Australian Consumer Law (ACL). This policy outlines consumer guarantees relating to product quality, fit-for-purpose requirements, and available remedies for non-compliance.
2. Consumer Guarantees Under Australian Law
Under the ACL, all products sold by The Groove Man come with automatic consumer guarantees that cannot be excluded. Consumers are entitled to expect that goods:
- Are of acceptable quality – safe, durable, and free from defects.
- Are fit for purpose – suitable for the intended use described by the seller.
- Match any description, sample, or demonstration model.
- Have clear title and ownership, free from third-party claims.
- Come with a right to repairs and spare parts for a reasonable period.
These guarantees apply regardless of any manufacturer warranty and are enforceable under the Competition and Consumer Act 2010 (Cth).
3. Remedies for Non-Compliance
If a product does not meet consumer guarantees, customers are entitled to a remedy, which depends on whether the issue is major or minor:
- Minor failures: The Groove Man may choose to offer a repair, replacement, or refund.
- Major failures: Customers are entitled to a full refund, replacement, or compensation for loss.
A major failure occurs when:
- The product is unsafe.
- The defect would have stopped someone from purchasing it had they known.
- The product is significantly different from the description.
- The issue cannot be fixed within a reasonable time.
Customers cannot claim a remedy if:
- The issue is caused by misuse, accidental damage, or neglect.
- They simply change their mind (unless covered under our Change of Mind Policy).
- The problem is minor and can be fixed within a reasonable timeframe.
4. Making a Consumer Guarantee Claim
To make a claim under the ACL, customers must:
- Provide proof of purchase – such as a receipt, tax invoice, or order confirmation.
- Describe the issue – include details and, if possible, photos of the product.

Once assessed, we will provide the appropriate remedy in line with ACL requirements.
5. Additional Warranties and Manufacturer Guarantees
Some products may come with manufacturer warranties that provide additional coverage. These do not override or limit consumer guarantees under the ACL.
If a product has an extended manufacturer warranty, customers may choose to:
- Claim a remedy through The Groove Man under ACL consumer guarantees.
- Contact the manufacturer directly for warranty service.
